Terms of Service
Effective Date: June 14, 2026
1. Acceptance of Terms
By accessing fortem.dev or using the Fortem service, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service. These Terms apply to the hosted website (fortem.dev), discovery call scheduling, and the Fortem control plane software deployed in your AWS account.
2. The Service
Fortem is an ECS Fargate fleet management platform. The Fortem control plane is deployed inside your own AWS account and operates using the task role attached to the ECS task (Fargate) or the IAM instance role on the EC2 instance where it runs. Cybrix, LLC does not access your AWS account. Cybrix, LLC provides:
- ·The Fortem control plane software (environment scheduling, fleet management, AI diagnostics via Amazon Bedrock)
- ·The fortem.dev marketing website and documentation
- ·The Fleet Audit skill — a local AI tool that runs against your AWS CLI profile on your own machine
- ·Early access and design partner program enrollment
- ·Discovery call scheduling and sales support
3. Your AWS Account & Data
The Fortem control plane runs entirely inside your AWS account. Cybrix, LLC does not connect to, access, or monitor your AWS environment. Specifically:
- ·The control plane authenticates via the task role (ECS Fargate) or IAM instance role (EC2) within your account — no credentials are shared with Cybrix
- ·Your ECS workloads, task definitions, secrets, environment variables, and application data never leave your AWS account
- ·AI features use Amazon Bedrock running inside your AWS account under your own Bedrock configuration
- ·The Fleet Audit skill runs locally on your machine against your own AWS CLI profile — no data is sent to Cybrix servers
- ·Cybrix, LLC does not store, receive, or have visibility into your infrastructure, workloads, or cost data
4. Early Access & Design Partners
Participation in the early access or design partner program does not create a contractual obligation on either party. We reserve the right to accept or decline applicants at our discretion. Early access terms, including any discounts or pricing commitments, will be communicated separately in writing.
5. Acceptable Use
You agree not to:
- ·Use fortem.dev or the Service for unlawful purposes
- ·Attempt to gain unauthorised access to our systems
- ·Misrepresent your identity or affiliation when contacting us
- ·Use the Fortem software to violate third-party infrastructure policies or cloud provider terms
6. Intellectual Property
The Fortem name, logo, and website content are the property of Cybrix, LLC. Nothing in these Terms grants you the right to use Cybrix or Fortem trademarks without prior written consent.
7. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. CYBRIX, LLC DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Fortem service will operate without errors, that it will be compatible with your specific AWS account configuration, or that any particular feature will be available by a specific date.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CYBRIX, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR INFRASTRUCTURE COSTS, ARISING FROM YOUR USE OF THE SERVICE. Our total liability for any claim arising from these Terms shall not exceed USD $100.
9. Governing Law
These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Natrona County, Wyoming.
10. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated to users via email. Continued use after changes constitutes acceptance.
